By downloading, installing, or using Sugarlytics (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

1.1 Geographic and Platform Availability

Sugarlytics is currently available only on iOS devices in the United States. The App requires a Dexcom continuous glucose monitor (CGM) for core functionality. By using the App, you represent that you are located in the United States and have access to a compatible Dexcom CGM device. We do not offer or support the App on Android or outside of the United States at this time.

2. Description of Service

Sugarlytics is a wellness and lifestyle tracking tool designed to help users log meals, track glucose data from connected CGM devices, and visualize historical patterns.

Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition or diabetes management. Never disregard professional medical advice or delay in seeking it because of something you have viewed in this App.

3.3 No Doctor-Patient Relationship

Use of Sugarlytics does not create a doctor-patient relationship between you and the developers, operators, or any affiliated parties.

3.4 Emergency Situations

If you think you may have a medical emergency, call your doctor or emergency services immediately. Sugarlytics is not designed for emergency use and should never replace emergency medical services.

4. User Responsibilities

You are responsible for the accuracy of the data you enter into the App. Inaccurate data may lead to inaccurate pattern analysis.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Limitation of Liability

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUGARLYTICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

SUGARLYTICS IS NOT LIABLE FOR ANY HEALTH OUTCOMES, MEDICAL DECISIONS, OR CONSEQUENCES ARISING FROM YOUR USE OF OR RELIANCE ON THE APP. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR DIABETES MANAGEMENT DECISIONS.

10. Indemnification

You agree to indemnify and hold harmless Sugarlytics, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the App or violation of these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

12. Termination

We may terminate or suspend your account and access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
